General Terms and Conditions of Sale
The www.theoriginals-store.renault.com website (the "Website") sells ranges of derivative products inspired by Renault vehicle models that can be ordered online from RENAULT s.a.s., a simplified joint-stock company, registered with the Nanterre Trade and Companies Register under number B 780 129 987, whose registered office is located at 122-122 bis avenue du Général Leclerc – 92 100 Boulogne-Billancourt, France (hereinafter "RENAULT") in accordance with these General Terms and Conditions of Sale which binds RENAULT and any person placing an order on the Site (hereinafter the "User").
0. preamble
These general terms and conditions of sale exclusively govern the contractual relations between RENAULT and the User who wishes to place an order on the Site.
They apply to any order for products placed on the Site to the exclusion of any other, in particular those in force for in-store sales.
Before finalising their order, the User acknowledges that they have read these general terms and conditions and expressly declares that they accept them without reservation.
RENAULT reserves the right to modify or adapt these general terms and conditions of sale. In the event of a change, the general terms and conditions of sale in force on the day of the order will be applicable.
1. ordering terms
When the User has chosen his product, he clicks on the "Add to cart" button. By clicking on this button, the User enters the online ordering process.
The User then validates his basket by clicking on "Place my order".
- With account creation
Subsequently, the User may, if he wishes, identify himself:
- if they already have an account: using their email and password, which will be strictly confidential. In the event of loss or forgetfulness of the password, the User may generate a new one by clicking on "Forgot your password?". They will then receive a new temporary password on the email address they provided at the time of registration, which will allow them to reset their password;
- If they do not have an account: they must create one by entering the following information: email, password, title, surname, first name, full address, landline or mobile phone.
The Customer will thus be able to track the status of their order via their account on the Site.
- No account created
The User may also, if he wishes, enter the order process, without creating an account. Once the shopping cart has been validated, the User must select the delivery address and accept the general terms and conditions. At this stage, the user will have the option to cancel or modify the elements of his order. Finally, the User must validate the payment method. This last step formalizes the sales contract between RENAULT and the User. During this last step, the User will be redirected directly to the secure site of RENAULT's banking partner and will be able to make his bank payment.
As soon as the booking is finalised, the website displays an order confirmation page, and the User will receive an email confirming their purchase within a maximum of 24 hours.
If the confirmation email is not received, it is the User's responsibility to contact RENAULT by email (support.theoriginals-store@renault.com) to ensure that their order has been taken into account.
2. products
The products sold and their characteristics are presented on the Site. The User can refer to the description on the page of the relevant product.
They can be sold alone or bundled as part of a single order.
Some specific products are made to order, implying a longer shipping time (up to six weeks from the time of ordering). When a product is made to order, this is clearly indicated in the product sheet on the Site with an estimated delivery date. The Client will receive all information concerning his order and future delivery via emails or by logging into his account.
3. product availability
Product offers and the prices associated with them are valid as long as they are visible on the website. All transactions are made within the limits of available stocks. A check of availability is carried out each time an order is received, at the depot. Photographs of the products are not contractual.
In the event of unavailability of the products ordered, i.e. if it is impossible for RENAULT to deliver to the User within the time limits set out in Article 4.2 below, RENAULT shall inform the User by e-mail or telephone and inform him/her of the probable period within which his/her order could be honoured. It will therefore be the User's responsibility to inform RENAULT, within 48 hours, whether or not he wishes to maintain his order.
If the User cancels his order, RENAULT will send him his refund within a maximum period of fourteen (14) days from receipt of payment of the sums he has paid.
4. financial conditions
4.1. Prices
The prices displayed on the Site are expressed in Euros including VAT, and are indicated excluding participation in shipping costs which are the responsibility of the User.
Depending on the User's place of connection, prices may not indicate taxes.
When the price is indicated including all taxes, value added tax (VAT) is payable at the applicable rate indicated when the order was placed.
The User is informed that the sale prices do not include any customs fees.
The legislation applicable to the User, depending on his country of connection, may provide for direct or indirect taxes that RENAULT does not collect. Any tax not indicated during the order process remains payable to the User, with regard to the legislation applicable in the country where the User placed his order.
As prices are always displayed in Euros, the User connected from a country whose currency does not correspond to the one used by the Site must inquire about the fees and exchange rates applicable at the time of placing his order.
The amount that the User will have to pay includes the sale price of the product, delivery costs and, where applicable, the taxes referred to above. This amount can be found on the order summary page.
These prices remain applicable only on the Site and can under no circumstances be the subject of a direct request in store.
RENAULT reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force as soon as the order is finally validated by the User.
4.2. Shipping costs
Except in exceptional commercial transactions, delivery costs are the responsibility of the Customer. Products and shipping and packaging charges are payable upon shipment.
Delivery costs are mentioned before the order is validated and invoiced in addition to the product(s) ordered. The amount of the shipping costs is fixed at a flat rate, depending on the country of shipment, taking into account the weight of the package.
4.3. Payment terms
The method of payment for the products for sale on the Site is payment by credit card or bank account. All payment methods are indicated by pictograms on the payment module integrated into the Site.
All payment transactions carried out on the Site are carried out securely and remotely directly and exclusively on the STRIPE online payment platform, a payment service provider and partner of RENAULT's RCI banque SA banking subsidiary. 5. shipping
Depending on the User's choice and the availability of the delivery location, the product may:
- either be collected in store (Renault the carwalk on the Champs Elysées);
- is delivered by a carrier to the delivery address provided by the User.
5.1. In case of in-store pick-up
In the event of in-store pickup, no delivery costs will be charged to the User.
RENAULT undertakes to make available to the User the product(s) ordered in the Renault fashion show store within a maximum period of 3 working days.
If this period exceeds 7 days, the User has the option of requesting the cancellation of the sale unless this delay in delivery is due to a case of force majeure, by sending an email to Customer Service. It will then be reimbursed under the same conditions provided for in Article 3(5).
When the User collects it, the User must present an identity document and their order confirmation.
5.2. In the event of home delivery
At the time of delivery, the recipient must be able to present an identity document and their order confirmation. In case of absence, the recipient will receive a delivery note and will have to agree on a new delivery or collection date with the carrier.
5.3 In the event of delivery to a relay point
The User can also opt for delivery to a relay point and select the relay point of his choice in the Mondial Relay and Chronopost networks.
5.4. Place of delivery – Possible customs duties
Deliveries are made in France, within the European Union and abroad.
For deliveries abroad, especially outside the European Union, the order may be subject to customs duties, import taxes or other fees payable on arrival in the country of delivery. These costs, which are not included in the price of the products or in the delivery costs invoiced by RENAULT, remain the sole responsibility of the User. It is the User's responsibility to obtain prior information from the competent authorities in their country about the applicable formalities and costs. RENAULT shall not be held liable for the payment of such duties, taxes or fees, nor for the consequences of failure to pay by the User.
5.5. Delivery time
Orders are shipped (i.e. handed over to the carrier) within an average of three working days from their validation.
The average delivery time depends on both the delivery address and the mandated carrier (Colissimo or DHL).
If it is impossible for RENAULT to meet the order processing deadline, the procedure will be as indicated in Article 3 paragraphs 4 and 5 on the availability of products.
5.6. Late delivery
A delay in delivery may in no way result in the payment of damages to the User. In particular, RENAULT cannot be held liable for the consequences of delays beyond its control, in particular cases of force majeure or the carrier's act, which would delay or prevent the delivery or delivery of the products ordered.
5.7. Missing/Damaged
In the case of a parcel delivered in person, the User undertakes, after checking the content of the parcel(s), to sign the delivery receipt from the carrier.
In the event of a shortage or damage, the User must make reservations on the attendance sheet, also signed by the carrier, and must keep a copy of the document. In the event of damage, he must also refuse the package(s) by adding his "refusal for damage" to the delivery receipt.
Without issuing precise reservations at the time of signing the delivery receipt, it is up to the User to provide proof that the damage occurred during transport and that the damage is attributable to transport.
The User must confirm his or her reasoned protests to the carrier by registered letter addressed to the "User Service" (whose contact details appear on the transport slip) within three days of delivery of the product and send a copy of his or her letter to RENAULT.
5.8. Non-compliance
In the event of non-compliance of the order with regard to its quality or quantity, the User must inform RENAULT by email addressed to support.theoriginals-store@renault.com.
5.9. Refusal of delivery
RENAULT reserves the right to refuse a delivery or to honour an order for a User who has not paid in full or in part for a previous order or in the event of an order in dispute.
6. risk transfer
All products shipped in France, Europe or abroad travel at the User's expense, risk and peril.
In the event of in-store collection, the transfer of risk on the products ordered takes place as soon as they are collected by the User.
In all cases, it is the User's responsibility to make any possible complaint concerning the products (in particular in the event of damage, apparent defect or missing element) and to make all necessary observations and reservations at the time of receipt or, where applicable, to refuse acceptance.
7. retention of title
All products sent remain the property of RENAULT until full payment has been received for the order.
8. warranties
8.1. Legal guarantees
In the event of delivery of a defective or non-compliant product, RENAULT undertakes, depending on the User's choice, either to refund the price of the product or to exchange the product with a product of equivalent quality and price depending on the available stocks. For any request of this type, the User must contact RENAULT via the contact form on the Site.. The User benefits from the legal guarantees in accordance with the following provisions:
- Article 1641 of the Civil Code: the seller is bound by the warranty for hidden defects in the item sold that make it unfit for the use for which it is intended, or that so diminish this use, that the User would not have acquired it, or would have given only a lower price, if he had known about them.
- Article 1648 paragraph 1 of the Civil Code: the action resulting from these redhibitory defects must be brought within two years of the discovery of the defect.
- Article L217-4 of the Consumer Code: The good is in conformity with the contract if it meets the following criteria, if applicable:
- It corresponds to the description, type, quantity and quality, in particular with regard to functionality, compatibility, interoperability, or any other characteristic provided for in the contract;
- It is suitable for any special use sought by the consumer, brought to the attention of the seller at the latest at the time of the conclusion of the contract and which the latter has accepted;
- It is delivered with all accessories and installation instructions, to be supplied in accordance with the contract;
- It is updated in accordance with the contract.
- Article L217-5 of the Consumer Code.
- I.-In addition to the criteria of conformity with the contract, the property is compliant if it meets the following criteria:
- It is appropriate for the use usually expected of goods of the same type, taking into account, where appropriate, any provisions of European Union and national law as well as all technical standards or, in the absence of such technical standards, the specific codes of conduct applicable to the sector concerned;
- Where applicable, it has the qualities that the seller presented to the consumer in the form of a sample or model, before the conclusion of the contract;
- Where applicable, the digital elements contained therein shall be provided in the most recent version that is available at the time of conclusion of the contract, unless the parties agree otherwise;
- Where applicable, it is delivered with all accessories, including packaging, and installation instructions that the consumer can legitimately expect;
- Where applicable, it is provided with the updates that the consumer can legitimately expect, in accordance with the provisions of Article L. 217-19;
- It corresponds to the quantity, quality and other characteristics, including in terms of durability, functionality, compatibility and safety, that the consumer can legitimately expect for goods of the same type, having regard to the nature of the goods as well as to the public declarations made by the seller, by any person upstream in the chain of transactions, or by a person acting on their behalf, including in advertising or on labelling.
- II.-However, the seller is not bound by any public declarations mentioned in the preceding paragraph if he demonstrates:
- That he did not know them and was not legitimately in a position to know them;
- That at the time of the conclusion of the contract, the public declarations had been rectified under conditions comparable to the initial declarations; or
- That public statements could not have had an influence on the purchase decision.
- III.-The consumer may not contest conformity by invoking a defect concerning one or more particular characteristics of the goods, which he has been specifically informed to deviate from the conformity criteria set out in this article, a deviation to which he expressly and separately consented at the time of the conclusion of the contract.
- I.-In addition to the criteria of conformity with the contract, the property is compliant if it meets the following criteria:
- Article L217-7 of the Consumer Code: Lack of conformity that appears within twenty-four months of the delivery of the good, including goods containing digital elements, are, in the absence of proof to the contrary, presumed to exist at the time of delivery, unless this presumption is incompatible with the nature of the good or the defect invoked. For second-hand goods, this period is set at twelve months.
8.2. Contractual guarantee
The products may give the right to a contractual warranty, mentioned by the manufacturer on the product manual. This contractual guarantee does not prevent the legal guarantees provided for by Articles 1641 et seq. of the Civil Code and Articles L.217-1 et seq. of the Consumer Code. The following are excluded from this contractual guarantee:
- Replacement of consumables,
- Abnormal or non-compliant use of the products,
- Breakdowns related to accessories (power cables, etc.),
- The consequences of the non-compliant use of the product for the purpose for which it is intended,
- The consequences of any external cause,
- Interventions and repairs carried out on the product outside the warranty circuit or by a third party.
It is imperative to keep the purchase invoice in order to benefit from the product warranty. For any request relating to the contractual warranty, the User must contact RENAULT by e-mail: support.theoriginals-store@renault.com or via the contact form on the Site.
9. responsibilities
The products offered for sale on the Site comply with the French and European legislation in force.
The choice of products is the sole responsibility of the User. RENAULT cannot be held liable in the event of total or partial impossibility of using the product(s), in particular due to the incompatibility of the product.
RENAULT cannot be held liable for any non-performance of the contract due to force majeure, strikes or disruption of postal services.
10. right of withdrawal
Pursuant to Articles L.221-18 et seq. of the Consumer Code, the User has a period of fourteen (14) clear days from the date of delivery of his order to exercise his right of withdrawal without having to justify reasons or pay penalties.
When the User wishes to exercise his right of withdrawal within the legal period of fourteen (14) days, he can do so directly online from the Site, by clicking on the button "withdraw from the contract here" or any equivalent formula.
The User is then invited to fill in the information allowing the identification of his order, in particular his first and last name, his email address and the order number concerned.
Before the final validation of their request, the User can check the information entered. He then confirms his withdrawal by clicking on "confirm withdrawal". RENAULT will then immediately send the User an acknowledgement of receipt of his request by e-mail.
The products must be returned no later than fourteen (14) days after receipt by the User, as evidenced by the postmark. The products must be returned in their original packaging, unused, in perfect condition and accompanied by all their instructions or accessories as well as the invoice concerned. Items returned that are used, damaged, dirty, or damaged cannot be taken back
After receipt and acceptance of the return by RENAULT, the User will be offered, at his choice, either the reshipment of a new product or the refund of the product. In the latter case, the refund will be made no later than fourteen (14) days following the date on which this right was exercised.
10.1. Orders in France and the European Union
To make a return, the User who has placed an order in France or within the European Union must pay the costs of returning the products.
The User will also have the option of sending a letter to RENAULT at the following address: STACI 3, Comvenant The Originals Renault Store 3921, 39 avenue des Béthunes, ZAC des Béthunes, 95310 SAINT OUEN L'AUMONE, FRANCE, via the form below, in order to notify them of the return of their order for withdrawal, and to indicate whether they opt for a refund or the reshipment of a new product.
In the event that the order that is the subject of a return (total or partial) benefits from a promotion, the benefit of this offer may be called into question if the eligibility conditions are no longer met, the refund being then calculated on the basis of the price actually due for the Products kept by the User.
10.2. Orders outside the European Union
When the User who wishes to make a return is outside the European Union, he or she must pay the costs for the return of the package.
11. securing the Site
In the context of the online sales process, RENAULT is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service or other problems beyond its control.
Bank details are encrypted using the SSL (Secure Socket Layer) protocol and never pass through the network in clear.
RENAULT never has access to confidential information relating to the User's means of payment, which is inaccessible by a third party. All payments are made directly to our banking partner.
12. personal data
The User's personal data is collected and processed by RENAULT for the purposes of this contractual relationship and to communicate offers and news.
In accordance with the applicable regulations, the User may request to obtain and verify the data that RENAULT holds on him/her, rectify inaccurate information, delete data concerning him/her, and take a copy of his/her data with him or her to reuse it elsewhere. They may also object at any time to the use of some of their data, in particular for commercial prospecting or profiling purposes, and request to freeze the use of their data. Finally, the User can define directives relating to the fate of his or her data in the event of death. The customer may exercise all of his rights directly with Renault SAS by sending his request via form https://www.renault.fr/vos-droits.html or by post to the address: Renault SAS Legal Department – Data Protection Officer, 122-122bis Avenue du Général Leclerc 92100 Boulogne-Billancourt. In the absence of a response or satisfactory response from Renault, the customer has the option of filing a complaint with the Commission Nationale Informatique et Libertés (CNIL).
The User has the right to register free of charge on the Bloctel opposition list in order not to be subject to commercial solicitations by telephone.

13. intellectual property
All elements (including texts, logos, images and drawings) of the Site are the exclusive property of RENAULT or the holders of the rights that have authorized RENAULT to use them and are reserved for intellectual property purposes worldwide.
Any total or partial reproduction of the Site is strictly prohibited.
14. archiving – evidence
In accordance with the provisions of Article 1348 of the Civil Code, the summaries of purchase orders are archived on a reliable and durable medium for a period of ten years.
RENAULT's computerized records will be considered by the parties as proof of the reality and date of communications, orders, payments and transactions between the parties.
15. applicable law – disputes
These General Terms and Conditions of Sale are subject to French law.
In the event of a complaint or dispute relating to the formation, validity, interpretation, execution or termination of these General Terms and Conditions of Sale, the User is invited to contact RENAULT in advance in order to seek an amicable solution.
In the absence of an amicable resolution, any dispute will be brought before the competent courts under the conditions provided for by the applicable rules of civil procedure, without prejudice to the mandatory protective provisions that the User may benefit from in his capacity as a consumer.
