The purpose of these general conditions of use (hereinafter "T&C") is to define the terms and conditions of use of "theoriginals.renault.com" and "theoriginals-store.renault.com" websites

Access to and use of the Websites implies the unreserved acceptance of the T&Cs by the User.

1. definitions

for the purposes hereof:

"Websites" shall mean the "theoriginals.renault.com" and "theoriginals-store.renault.com" websites published by RENAULT giving access to the Elements. The websites include the Content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements constituting it, updates and new versions that may be added to the Websites by RENAULT.

"Content" shall mean, without this list being exhaustive, the structure of the Websites, the editorial content, drawings, illustrations, photographs, graphic charters, brands, logos, insignia, trade names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present within the Websites.

"Elements" shall mean the various features and elements of information offered on the Websites.

"Renault Group" refers to the various legal entities of Renault, the car manufacturer.

"User" shall mean a physical person of legal age navigating on the Websites for their own needs, strictly for personal use only and not commercial use, and not for direct or indirect profit.

2. purpose of the websites

The Websites allow the user to:

  • Discover the models of the Renault brand and their history,
  • Buy merchandising items from the Renault brand

This list is not exhaustive and may be modified at any time by RENAULT without incurring any liability as a result.

3. website access

The Websites can be accessed from the Internet at the following addresses: "theoriginals.renault.com" and "theoriginals-store.renault.com"

4. website user licence

RENAULT grants the User a personal right to use the Websites, Content and their non-exclusive, revocable, non-transferable and free Elements.

This licence is granted to the User only for his/her own needs, to the exclusion of any commercial or profit-making exploitation of all or part of the Content and/or the Elements.

The User shall not acquire any other right on the Websites, Content and/or Elements other than those granted hereunder.

5. obligations of the user

The User undertakes to use the Websites in accordance with national and international regulations.

In particular, he/she undertakes to:

  • read and comply with these T&C,
  • not to replicate, even temporarily and/or partially, the Websites and/or its Content, by any means and in any format,
  • not to access and/or use the software components of the Websites,
  • not to use software or processes intended for copying the Content and/or which may disrupt the proper functioning of the Websites,
  • not to proceed with any adaptation, modification, translation, transcription, compilation, decompilation, assembly, disassembly of all or part of the Websites, Elements and/or Content,
  • not to export the Websites and/or merge them with other computer programs,
  • inform RENAULT if it becomes aware of an act of piracy and/or the illicit or non-contractual use of the Websites and/or its Content.
  • not to perform any manipulation and/or introduce any virus or malicious code, likely to cause computer and/or functional failures that may affect the proper functioning of the Websites or any Elements accessible through the Websites.
  • not to hinder the proper functioning of the Websites by any means whatsoever,
  • not to use the Websites to display, download or transmit any content contrary to morality and public order (such as, without limitation, any racial, political, religious, pornographic or sexual content)

Only the User is responsible for the use of the Websites. He/she acknowledges that neither RENAULT nor the members of its distribution network may be held responsible for direct or indirect damage, and in particular material damage, immaterial damage, loss of data or programs, financial damage, resulting from access to or use of the Websites, or as a result, in particular of the interruption, suspension, or modification of the Websites or one of its Elements.

6. website availability

RENAULT undertakes to make every effort to secure the access, consultation and use of the Websites.

The Websites are permanently accessible, except in the case of force majeure or the occurrence of an event outside of RENAULT’s control, and subject to possible breakdowns and maintenance required for the proper functioning of the Websites.

7. liability - warranty

on the use of the Websites

Within the limits of applicable laws and regulations, neither RENAULT nor the dealers of its distribution network, assume responsibility for the use of the Websites by the User and give no warranty, express or implied, with regard to the speed or performance of the Websites. In particular, access to the Websites may be temporarily and periodically suspended for technical reasons; where applicable, the technical teams will make their best efforts to resolve the problem at their earliest convenience.

RENAULT reserves the right to modify, at any time and without prior notice, the information appearing on the Websites, and the liability of RENAULT and/or that of the members of its distribution network and/or that of its subsidiaries cannot be sought for this reason.

Access to and use of the Websites shall be at the User’s own risk. It is the User’s responsibility to take all appropriate measures to protect their his/her data and/or software stored on his/her telephone and computer equipment against any damages.

In any event, RENAULT shall be released from any liability:

  • in the case of non-compliance by the User with these T&Cs;
  • in the case of the malfunctioning of the Websites due to a cause, whether intentional or not, that is attributable to the User, a third party or to a malicious act, of the software, a smartphone/tablet, an interface or any other product or provision of the User;
  • in the case of the malfunctioning and/or failure of the User’s computer and/or communications network for any reason whatsoever

RENAULT does not guarantee that the Websites are free of any errors or anomalies or that it might not be subject to attacks, particularly by viruses, which may lead to malfunctions, disruptions, breakdowns or losses of data or information.

8. personal data

Use of the Websites may require the collection of personal data by RENAULT allowing direct or indirect identification of the User.

9. intellectual and industrial property

The Websites and their Content are protected under intellectual and/or industrial property rights.

The photographs, texts, slogans, drawings, images, animated sequences with sound or otherwise, including any works integrated into the Websites are the property of RENAULT or of a third party that has transferred their rights to RENAULT or authorised RENAULT to use them.

The Vehicle models displayed on the websites are protected under copyright and Articles L511-1 et seq. of the French Intellectual Property Code relating to the protection of registered models.

The name RENAULT, the names of the Vehicles in the RENAULT range and the associated products and services, as well as the slogans and logos accompanying these brands are, unless otherwise specified, registered trademarks of RENAULT or other companies within Renault Group.

Other brands which may also be mentioned are used by RENAULT either with the authorisation of their owner, or as a simple indication of products or services offered by RENAULT.

The reproduction, on paper or on electronic medium, of the Content is authorised, provided that it is strictly limited to personal use excluding any use for advertising and/or commercial and/or informational purposes and that it must be compliant with the provisions of Article L122-5 of the French Intellectual Property Code.

With the exception of the above provision, the reproduction, imitation, use or affixing, by any process and on any medium whatsoever, of all or part of the Content without having obtained prior authorisation from RENAULT or the holder(s) of the related rights constitutes counterfeiting punishable by four years imprisonment and a €400,000 fine.

10. applicable law

The websites and these T&C are subject to French law, subject to the mandatory rules of the User's country of residence.

Any dispute that arises concerning the interpretation and/or execution of these T&C must be the subject of an attempt to settle amicably.

In the absence of an amicable settlement, the dispute will be submitted to the courts within the jurisdiction of the Paris courts to which the parties assign exclusive jurisdiction, notwithstanding the plurality of defendants or claims for compensation from third parties.

11. updating of the T&C

RENAULT reserves the right to modify and update these T&Cs without prior notice at any time and without informing Users.

Where applicable, modifications and updates are binding on the User as of their publication on the websites, it being the User’s responsibility to consult the T&Cs in force on each connection to the websites.

12. miscellaneous provisions

12.1. no waiver

The fact that one of the parties does not invoke one of the clauses of these T&Cs will not be interpreted as a temporary or definitive waiver of the benefit of the provision in question, which will remain applicable.

12.2. nullity of a clause

If one or several stipulations of these T&Cs is declared null, void, or unwritten on the Website of current regulations, a change or following a definitive decision from a competent jurisdiction, the other stipulations will retain all their force and scope, and the parties commit to setting up, as soon as possible, a valid substitute provision with an equivalent scope, which is as close as possible to the spirit of these provisions.

12.3. force majeure

The following are expressly considered to be cases of force majeure, in addition to those which are customarily considered as such by the case law of the French courts: adverse weather conditions, legal or governmental restrictions, computer breakdown, interruption of telecommunications, the failure of the RENAULT servers and any other case outside of the express control of RENAULT.
